Energy Employees Occupational Illness Compensation Program Act (EEOICPA)

The EEOICPA was enacted to provide compensation and medical benefits to current and former workers at DOE facilities, including contractor and subcontractor employees, for medical conditions related to their work. The Department of Labor (DOL) processes all EEOICPA claims. DOE assists DOL in securing the necessary records to support EEOICPA claims, e.g., personnel, medical, exposure.

For records at an Office of Science (SC) national laboratory or facility, the SC ISC works with its supported SC Site Offices and the associated national laboratory or facility to provide DOL with records to support EEOICPA claims. In addition, upon request, the SC ISC provides copies of those records to former workers or their legal representatives or family members in connection with their EEOICPA claims. For requests to the ISC by former workers, a Privacy Act request should be submitted to the Privacy Act Officer at the ISC location having records jurisdiction at the respective record location. Must I request my exposure, medical, and personnel records in order to file a compensation claim under the Energy Employees Occupational Illness Compensation Program?

NO! You are not required to submit employer-owned or Privacy Act records to file a claim under the Federal Compensation Program. Your signature on the claim form authorizes the U.S. Department of Labor (DOL) to access the necessary records. DOL will contact you if further information is required. You may request a copy of your completed Federal compensation claim file by submitting a Privacy Act request to DOL. This would include any records DOE assisted in providing to DOL from a DOE national laboratory or facility. You also need not obtain these records to file a State Workers Compensation Claim. DOE's Office of Worker Advocacy – Former Workers Screening Program will obtain any available records and provide them to the panel of doctors that reviews your claim. You may request a copy of the medical and exposure records evaluated by the panel of doctors from the U.S. Department of Health and Human Services.
